Exclamation Victorian Planning Changes

Back in about 2006 the then Labour gov in Victoria revamped the planning requirements for a number of zones including the Farm Zone. In their wisdom a prohibition of "Motor Racing Track" was included in the zone. While not tightly enforced due to many events (4X4, Off Road Racing, etc.) largely being conducted under the radar it has limited options for event organisers. The current government is about to change the planning requirement and allow "Motor Racing Track" as a use that can seek a planning permit.

What difference will this make if they do?

Events such as the International super trial held at Sedgwick a few years ago could soon again be held on private land as could any future WTC rounds. We were so lucky to have had the use of the public land at Maldon this year but this may not always be the case.

This also has am impact on enduro events like the VORC and numerous racing tracks like Barrabool Hills and any others that are still in operation on land zoned "Farm Zone"

I urge you to make a submission supporting the changes to the Farm Zone and also suggest you seek "Motor Racing Track" be removed from the "Green Wedge Zone" as this also has an impact on areas used by some trials and off road competition locations.

A step in the right direction....

But be aware, it also means that clubs need to become more professional in their approaches and dealings with Government at all levels.
As that is one of the biggest issues here, some of the organisors want the community to subsidise their pasttime, and obviously unlike footballers and cricket it is porobably not going to happen, much as I love my sport (duh) I can see both sides of the coin.

But again a good move in the right direction, support it people, dominoes fall

Some additional information:

There are four Rural Zones - Farming, Rural Living, Rural Activity and Rural Conservation. The proposed changes continue to prohibit the land use Motor Racing Track in both Rural Living and Rural Conservation zones, and continue to make it possible subject to permit in Rural Activity zone. No changes for these three zones. The change applies to Rural Farming zone where the land use Motor Racing Track comes off the prohibited list and goes onto the list of uses that is possible subject to permit.

As an aside, the prohibition of Motor Racing Tracks in the Farming zone may have been misunderstood by local authorities responsible for implementation of these regulations. The prohibition was really directed towards the construction of permanent Motor Racing Tracks which due to the permanent nature of the construction becomes a land use.

In respect of the occasional use of private land for an enduro or trials event, such occasional use may not at law constitute a land use under the meaning of these regulations, but some local authorities may have interpreted it as a land use.

By way of example, conducting a garage sale twice a year from your residential property does not constitute a commercial retail land use for your property and you would not be required to get planning permission or a permit for your garage sale. But if you operated a seven day per week, year round garage sale from your residential property, that would constitute a change of use which is not permitted in a residential zone without approval.

So, there has always been a strong case that an occasional enduro or trials event may not constitute a land use. The proposed change of Motor Racing Track from the prohibited to the permit required list for Rural Farming properties will help those clubs which run such events to do so more easily in respect of getting a permit from the local authority.

Awesome work Bruce and thanks for sharing! Hopefully, this can clarify procedure and reduce bureaucracy (much to the disdain of those whose jobs may be threatened -as if! - it's the government!)

Technically you are very accurate but unfortunately local government always seeks the easy way out and that was to term any competition use as motor racing and therefore the actual site became the "Motor Racing Track" even though the was no infrastructure or contructed surfaces. Myself, Motorcycling Victoria and other interested parties had a number of meetings with senior planning officials at Nicholson St when this came in to little avail so I am pleased to see the prosect of change now. Just a shame for those that have been caught up in the BS in dealing with local government along the way.


It is funny (for want of a better word) to see the proposed changes to the rural zones. It is the usual full opposite of what the previous government put in place. Some of us will have to continue with stringent planning conditions and defined links to agriculture and farming for operations like host farms when a neighbour may soon be able to buids a restaurant and motel that offers little to the sustainablity of the agricultural Victoria. Glad I got out of agripolitics years ago........... bad enough on the motopolitics scene

Oh well, maybe I'll build the Otway Bogan Bikers Motel and get in early!!!
